Are you eligible to file for divorce in the Syariah Court?

To file for divorce in the Syariah Court, you or your spouse must be Singaporean, a Singapore permanent resident or have lived in Singapore for at least 3 years before filing for divorce.

What are the Grounds of Divorce

Whether you are a husband who has pronounced or intends to pronounce Talaq or a wife seeking divorce, we provide strategic advice which caters to your specific situation.

If the husband has already pronounced Talaq, he only has to prove that the pronouncement was valid. Otherwise, the husband can pronounce Talaq in the Syariah Court proceedings.

A wife has more grounds to apply for divorce under the Administration of Muslim Law Act:

  • Divorce at wife’s request with the husband’s consent;
  • Divorce by redemption (khuluk);
  • Breach of the conditions of marriage (cerai taklik); and
  • Fasakh.

What happens in the Syariah Court?

Mediation in the Syariah Court offers an opportunity to amicably resolve the divorce and all the related matters. We strongly believe in negotiating from the beginning to make full use of this opportunity and save both time and costs.

If the mediation is not successful, the divorce will proceed on a contested basis. We will then sift through the facts of your case and present what is relevant in the form of affidavits. This fact sensitive stage is crucial to the outcome on the various issues including nafqah iddah, mutaah, custody and care and control of children and the division of the matrimonial home and the division of property.

What counts as property in a divorce?

  • The family home;
  • Anything gained during the marriage; and
  • Anything owned before the marriage that was significantly improved during the marriage.

What does not count as property in a divorce?

Gifts or inheritances that were kept separate and not significantly improved during the marriage.

 

ENFORCEMENT OF THE SYARIAH COURT’S ORDERS

Our role does not end with the divorce. Post divorce, there may be a need to apply for enforcement of the Syariah Court’s orders, if the other party fails to comply or refuses to co-operate. We will then assist clients to apply to the Family Justice Court for enforcement of the Syariah Court’s order.
